NGBA Terms and Conditions (“Agreement”)
Expectations of Membership:
Membership in this organization is critical to the operations and goals of this organization. Member associations, their individual members, and volunteers or staff members of the NGBA organization are expected to adhere to the common set of expectations.
Conduct: Each Member Association is expected to adhere to the spirit of the NGBA policies and procedures.
Team Participation: Each Team must comply with and report the information of its team activities and leadership as determined by the Board of Directors and pay all dues, fines, and fees by the NGBA due date. Team Captains are expected and required to attend the captain meetings (conference line or in person). Failure to report all required information, attend as required, and/or pay all monies due may result in NGBA suspension of or termination of membership, including possible other NGBA sanctions, until such time as compliance is achieved.
Athletic Participation: Players are limited to one team roster per event. Each team has 3 games (4 max) in one day. Health and safety are the number 1 reason players are limited to 3 games a day (4 max). A team shall register the minimum number of tournaments (tournament calendar) to be determined by the NGBA Board to be eligible to be crowned National Champions.
Legal Issues: No Member Association or individual may enter into a legal agreement using the NGBA incorporated name of this organization without the written consent of the Board of Directors.
Privacy: Use of the directories of this association is limited to official NGBA business only. Reproduction, sale, rental, lease, or use of the directories or any of its contents by any person or group other than the Board of Directors or ( with permission) member associations is strictly prohibited.
Drugs and Alcohol: Players under the influence of any drug or alcohol will not be allowed to participate in the games. Players that exhibit behaviors of intoxication, or smell of alcohol or marijuana will not be allowed to participate. The board of directors and the athletic trainer will make the final decision.
Suspension/Termination of Membership:
Member Teams and/or individual members of the NGBA may be suspended, for a time certain or indefinitely, and/or terminated from membership in this organization by a two-thirds (2/3) vote of the NGBA Board following a hearing before the Board, in a form and manner NGBA provided for by the Disciplinary Committee, unless provided for differently by express language in these bylaws.
A period of suspension may be ordered by the Board which may include specific restorative and accountability NGBA requirements and/or other sanctions, which if not met, may result in termination of membership. Automatic NGBA suspensions for failure to pay membership dues by the deadline established may be issued and repealed by the NGBA Commissioner.
Reinstatement of Membership Following Suspension or Termination: The Board may reinstate an NGBA suspended Member following a review by the Disciplinary Committee of the complaint leading to suspension and any corrective actions taken regarding the nature of the complaint. The Board may reinstate a suspended and/or terminated individual member of a team following a review by the Disciplinary Committee of the complaint leading to suspension and/or termination and any corrective actions taken regarding the nature of the complaint. Member Teams or Individuals suspended for a time certain are automatically reinstated to good-standing following the expiration of the time of suspension provided that qualifications for membership continue to be met. Terminated Member’s or Teams shall only be eligible for reinstatement through the process of petitioning for membership in the organization.

This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.ngba.com
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
Intellectual Property
The Site and its original content, features and functionality are owned by National Gay Basketball Association and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
Termination
The NGBA can terminate your access to the site and NGBA membership, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. If the NGBA Board of Directors finds the conduct of a member detrimental to the purpose and function of the National Gay Basketball Association, the board can terminate the member’s access to the site, and cancel their membership.
Distribution of printed information during and NGBA event, without the expressed or written permission from the NGBA, is strictly forbidden.

Our Site may contain links to third-party sites that are not owned or controlled by National Gay Basketball Association.
National Gay Basketball Association has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of California, United States, without giving effect to any principles of conflicts of law.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
Personal and Non-Commercial Use Limitations.
Unless otherwise specified, the picture and video are for your personal and non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, obtained from the NGBA site.
Removal of an Image
You must request for an image of yourself to be removed from the site or promotional material.
